Intellectual Property & Copyright Policy

Our Commitment to Intellectual Property

Radical Rainbows Art Collective is a marketplace for original, independent creative work. We take intellectual property rights seriously and expect every seller on our platform to do the same. We do not knowingly host infringing content and will act promptly on any valid IP complaint we receive.

This policy sets out: what sellers are required to warrant about their listings; what third parties can do if they believe their IP is being infringed; and how we handle takedown requests.

Definitions

In this policy, the following terms have the meanings set out below:

  • “Collective”, “we”, “us”, or “our” — Radical Rainbows Art Collective, operated by Sammy Young trading as Felt Like Rainbows.

  • “Platform” — our website and application at www.radicalrainbowcollective.com, together with any related services we provide.

  • “Seller” or “artist” — any person who registers to list, or who lists or sells, work through the Platform.

  • “Buyer” or “customer” — any person who purchases or attempts to purchase a product through the Platform.

  • “Listing” — any product, image, photograph, design, description, or other content a seller uploads to or offers through the Platform.

  • “Content” — any text, image, artwork, design, or other material uploaded to or displayed on the Platform.

  • “Rights holder” — a person who owns, or is authorised to act on behalf of the owner of, the intellectual property rights in question.

  • “Generative AI” — artificial intelligence systems or tools that produce images, designs, text, or other output in response to prompts or from training data, as distinct from tools used only to support or administer a seller’s work.

  • “Takedown notice” — a complaint submitted to us under Section 7 (How to Submit a Takedown Notice).

  • “Valid takedown decision” — a decision, made following investigation, that a listing infringes a rights holder’s rights; this term is used in our repeat infringer policy in Section 9.

  • “Business day” — any day other than a Saturday, Sunday, or public holiday in England and Wales.

Seller Obligations

Every seller on Radical Rainbows Art Collective warrants, as a condition of listing, that:

  • All products listed are their own original work, or they hold all necessary licences, permissions, and rights to create, sell, and reproduce the item being listed.

  • Their listings do not incorporate third-party copyright material — including artwork, photography, illustration, text, or design — without a valid licence to do so.

  • Their listings do not incorporate registered trademarks, brand names, logos, or character designs owned by third parties without a valid licence.

  • Their listings do not reproduce or closely imitate the work of another artist in a way that could constitute copyright infringement.

  • They have the right to upload and reproduce any artwork, photographs, or images used in their product listings and print-on-demand uploads.

Sellers indemnify Radical Rainbows Art Collective against any third-party intellectual property claim arising from their listings. This indemnity is set out in full in the Seller Terms and Conditions.

Stock images, fonts, and openly licensed material

Many infringement problems arise from material a seller believes they are free to use. The following applies to all listings:

  • Stock images, graphics, brushes, and digital assets may only be used where the seller holds a licence permitting commercial use and resale within a finished product, and the seller must keep proof of that licence.

  • Fonts and typefaces used in products for sale must be covered by a licence that permits commercial use; many free fonts are licensed for personal use only.

  • Material found through a search engine, social media, or a website is not free to use simply because it is publicly available.

  • Creative Commons or other openly licensed work may only be used in accordance with the specific licence terms, including any attribution, share-alike, or non-commercial conditions — note that “non-commercial” licences do not permit sale.

  • Public domain status varies by country and must be verified; if in doubt, do not use the material.

Sellers remain responsible for confirming they hold the rights to every element of a listing. If you cannot evidence your right to use a component, do not list the product.

Fan Art and Licensed Characters

Fan art is a grey area that sellers must understand before listing. Selling items that feature copyrighted characters, brands, musicians, athletes, or other protected IP — even as original artwork — is technically copyright and/or trademark infringement in most cases. This applies regardless of how original the artwork itself is.

Our position on fan art is as follows:

  • Listings that clearly reproduce copyrighted characters, logos, or brand identities without a licence will be removed.

  • Listings that incorporate a recognisable likeness of a real person (celebrity, athlete, musician) for commercial sale require explicit consent from that person. We will remove listings where this consent cannot be demonstrated.

  • Sellers who repeatedly list infringing fan art content after being notified will have their accounts suspended.

If you are unsure whether your artwork infringes third-party IP, seek legal advice before listing. We are not able to advise individual sellers on whether their specific work infringes a third party's rights.

Artificial Intelligence (AI) Policy

Radical Rainbows Art Collective exists to champion authentic, human-made creative work. We have a clear and deliberate position on artificial intelligence: AI may be used as a behind-the-scenes tool to support the people who make and sell work here, but it must never replace the human creativity that defines our marketplace. This section explains what is permitted, what is prohibited, and how we apply this policy.

Our position on AI

AI is a tool to give our makers more time to create — never a substitute for original, human-made work. Generative AI artwork may not be listed or sold on Radical Rainbows Art Collective under any circumstances.

We recognise that AI tools can remove repetitive, time-consuming tasks from a maker’s day. Used well, they free our artists to spend more of their energy on the original, hands-on creative work our customers come to us for. That is the only role we see for AI: a support tool, used by choice, that protects creative time rather than replacing creative skill.

Using AI in the permitted ways described below is entirely optional. No seller is ever required to use AI tools, and choosing not to use them will never disadvantage a seller on our platform.

Permitted uses of AI — your choice

Sellers may, if they choose, use AI tools for supporting and administrative tasks that do not form part of the creative work itself, including:

  • Research, idea exploration, and gathering reference information.

  • Drafting or refining written text such as product descriptions, shop policies, or customer messages (the seller remains responsible for accuracy).

  • Administrative and operational tasks such as scheduling, bookkeeping support, organising files, or planning.

  • Marketing support such as drafting social media captions, email copy, or marketing plans.

  • Background production aids that do not generate the artwork itself, such as workflow planning or learning new techniques.

In every case, the finished product offered for sale must be the seller’s own original, human-created work. AI may assist the work around the making — it may never make the work.

 

Prohibited uses of AI

The following are strictly prohibited on Radical Rainbows Art Collective:

  • Listing, selling, or offering any product that is wholly or partly generated by generative AI, including AI-generated images, illustrations, designs, patterns, text-to-image output, or AI-generated writing sold as creative work.

  • Using AI to generate artwork that is then hand-finished, traced, or lightly altered and presented as original handmade work.

  • Using AI image generators trained on other artists’ work to imitate a particular artist, style, or body of work.

  • Describing or implying that AI-generated work is handmade or human-created.

  • Using AI tools in any way that breaches another person’s intellectual property rights or any part of this policy.

Generative AI work is not permitted even where the seller believes the output is original, transformative, or substantially edited. Our standard is simple: the creative work sold on this platform must originate from a human maker.

Our own use of AI

We hold ourselves to the same principle. Radical Rainbows Art Collective may use AI tools internally for research, administration, customer-support drafting, and operational efficiency, so that our small team can spend more time supporting our artists. We do not use AI to generate artwork, and we never present AI output as the work of our makers.

We do not use, and we do not permit any third party to use, artwork, images, designs, or other creative content uploaded by our sellers to train, fine-tune, or develop AI or machine-learning models. This prohibition applies to data scraping, automated harvesting, and any bulk collection of content from our platform for AI training purposes. We treat unauthorised AI training on our artists’ work as a serious infringement and will act on it under Section 6 (Protection of Our Artists’ Work).

Checking and consequences

We may ask any seller to provide evidence that their listed work is human-created — for example, work-in-progress photographs, process videos, layered source files, or original sketches. Sellers must be able to demonstrate their creative process on request.

  • First instance: the listing is removed and the seller is formally notified.

  • Repeated or deliberate breaches: suspension or permanent removal of the seller’s account.

  • Misrepresenting AI-generated work as handmade is treated as a serious breach of trust and may result in immediate account termination without refund of fees.

A breach of this AI policy is also a breach of the Seller Terms and Conditions and of the warranties in Section 3.

We notify the seller of the complaint, share relevant details of the notice (excluding your personal contact information where appropriate), and request their response and any evidence within 5 business days.
4. Decision
Within 5 business days of seller response (or seller non-response)
We review all evidence and make a decision. If we find the listing infringes your rights, it is permanently removed. If we do not, we explain our reasoning.
5. Outcome notification
Within 1 business day of decision
We notify both you and the seller of the outcome in writing.

Repeat Infringers

We operate a repeat infringer policy. Sellers who receive three or more valid takedown decisions within any 12-month period will have their accounts permanently suspended from the platform. A “valid” decision is one where we find in favour of the rights holder following investigation.

Sellers whose accounts are suspended under this policy are not entitled to a refund of any fees paid and will be notified of the reason for suspension in writing.

⚠️  Submitting a false or misleading takedown notice or counter-notice may result in legal liability. We take misuse of this process seriously.

Our Intellectual Property

The Radical Rainbows Art Collective name, logo, branding, website design, and written content are the intellectual property of Sammy Young trading as Felt Like Rainbows and Radical Rainbows Art Collective. You may not reproduce, copy, or use any of our branding or content without our written permission.

Product images, artwork, and descriptions on our platform remain the intellectual property of the individual artists and sellers who created them, subject to the licences granted to us under the Seller Agreement.
